Often no legal counsel, often no adequate medical care and allegations of unlawful violence: Experts from the Anti-Torture Committee strongly criticize the conditions in Polish police custody and complain about a “complete lack” of progress. The Council of Europe has sharply criticized the Polish authorities for the conditions of people in police custody. The experts of the Anti-Torture Committee (CPT) of the Strasbourg country organization complained in a report that detainees often received neither legal assistance nor adequate medical care. There are also allegations of unlawful police violence. The experts expressed “deep concern” at the “complete lack” of progress on “basic safeguards against ill-treatment”. Poland has “done nothing to implement previous recommendations” from 2018, the report said. People in police custody only very rarely have access to a lawyer. In fact, it is only possible to seek legal advice from those who have the telephone number of their lawyer with them. Arrested persons are also systematically deprived of their right to inform their families or other third parties about their arrest.

Injuries poorly documented

The police generally provide medical care. However, injuries to detainees “remain poorly documented (if at all) and non-medical police personnel have unrestricted access to medical records,” the report said. A CPT delegation traveled to Poland in September 2019 to visit a number of prisons and police stations. Most of the respondents said they were treated “properly” in police custody, the report said. But there were also “allegations of excessive use of force” by police officers. Polish police officers should be “strongly” reminded that “all forms of ill-treatment (…) are unlawful and should be punished accordingly,” urges the CPT. In principle, police officers should be better trained. The Council of Europe’s Anti-Torture Committee has the task of monitoring compliance with the European Anti-Torture Convention. To this end, CPT members – prison experts, doctors and psychologists – visit institutions where people are being held in the 47 member states of the Council of Europe.
